Acceptance of Terms
By accessing or using the Voical application and the voical.app website (collectively, the "Service"), you agree to be bound by these terms of service. If you do not accept these terms, please do not use the Service.
These terms constitute a legal agreement between you and Mexar, the company that publishes Voical.
Service Description
Voical is a mobile nutritional tracking application that uses voice recognition to record your meals and automatically calculate calories and macronutrients.
The Service includes:
- Voice recognition for meal logging
- Automatic calculation of calories and macronutrients
- Progress tracking (weight, goals)
- Nutritional charts and statistics
- Cloud data synchronization
Important: Voical is a nutritional tracking tool and does not constitute medical advice. Always consult a healthcare professional for personalized nutritional guidance.
Registration and Account
Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and up-to-date information
- Maintain the confidentiality of your login credentials
- Notify us immediately of any unauthorized use of your account
- Be solely responsible for all activities that occur under your account
Eligibility
To use the Service, you must:
- Be at least 16 years old or have parental/guardian permission
- Have the legal capacity to accept these terms
- Not have been previously banned from the Service
Subscription and Payment
Premium Offer
Voical offers a Premium subscription with the following pricing:
- Monthly: EUR 4.99/month
- Annual: EUR 34.99/year (approximately EUR 2.92/month)
Free Trial
A 3-day free trial is offered to new users. At the end of the trial, your subscription will be automatically activated unless you cancel it before the end of the trial period.
Billing
Payments are processed by Apple through the App Store. By subscribing, you agree to:
- Automatic renewal of your subscription at the end of each period
- Billing through your App Store account
- Apple's payment terms and conditions
Cancellation
You can cancel your subscription at any time through your App Store account settings. Cancellation will take effect at the end of the current billing period. No pro-rata refunds will be issued for the remaining period.
Price Changes
We reserve the right to modify our pricing. Any changes will be communicated at least 30 days before taking effect and will only apply to new billing periods.
Usage Rules
By using the Service, you agree not to:
- Use the Service for illegal or unauthorized purposes
- Attempt to hack, damage, or disrupt the Service
- Use bots, scrapers, or other automated means to access the Service
- Impersonate another person
- Transmit viruses or malicious code
- Harass, threaten, or intimidate other users
- Resell or redistribute the Service without authorization
- Circumvent security measures or access restrictions
Intellectual Property
The Service, including its source code, design, text, graphics, logos, and all other content, is the exclusive property of Mexar and is protected by intellectual property laws.
Your use of the Service does not grant you any ownership rights. You are granted only a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these terms.
User Data
You retain ownership of the data you enter into the Service (meals, weight, goals). By using the Service, you grant us a license to use this data to:
- Provide and improve the Service
- Generate anonymized statistics
- Comply with our legal obligations
You can export or delete your data at any time through the application settings. For more information, see our Privacy Policy.
Limitation of Liability
No Medical Warranty
Voical is not a medical device and does not provide medical advice. Nutritional information is provided for informational purposes only. Always consult a healthcare professional before changing your diet, especially if you have health conditions.
Calculation Accuracy
While we strive to provide accurate nutritional calculations, errors may occur. Calculations are based on estimates and may vary depending on the actual products consumed. We do not guarantee 100% accuracy of nutritional information.
Service Availability
The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may suspend or discontinue the Service at any time for maintenance or other reasons.
Limitation of Damages
To the fullest extent permitted by applicable law, Mexar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether such damages are foreseeable or not.
Our total liability shall in no event exceed the amount you have paid to us in the past 12 months.
Indemnification
You agree to indemnify and hold harmless Mexar, its officers, employees, and partners from any claims, damages, losses, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these terms
- Your violation of the rights of third parties
Termination
By You
You may stop using the Service and delete your account at any time. Deleting your account does not automatically cancel your subscription - you must also cancel the subscription through the App Store.
By Us
We may suspend or terminate your access to the Service, with or without notice, if:
- You violate these terms
- Your use poses a risk to the Service or other users
- We are required to do so by law
- We discontinue the Service
Effects of Termination
Upon termination, you will lose access to your account and the data it contains. Provisions of these terms that by their nature should survive termination will remain in effect.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with a new update date.
In case of substantial changes, we will notify you by email or through a notification in the application at least 30 days before they take effect.
Your continued use of the Service after the changes take effect constitutes your acceptance of the new terms.
Governing Law and Jurisdiction
These terms are governed by French law, without regard to conflict of law principles.
Any dispute relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless otherwise provided by law for consumers.
If you are a consumer residing in the European Union, you benefit from the protection of the mandatory provisions of the legislation of your country of residence.
